Julia is the founder and principal of Julia Clarke Solicitor and one of the Hunter Region’s most experienced criminal law practitioners - bringing decades of courtroom experience and a fierce commitment to her clients’ rights.

Julia established the firm with a clear purpose: to provide individuals, families and businesses in East Maitland and the wider Hunter Region with access to skilled, approachable and results-focused legal representation. That purpose shapes everything the firm does.

Her practice is anchored in criminal law and family law, where she has built a formidable reputation across the Local and District Courts. Julia represents clients across the full spectrum of criminal matters - from bail applications and AVOs through to serious charges including assault, fraud, drug offences and sexual crimes. She is Legal Aid approved and deeply committed to ensuring that every client receives skilled and vigorous representation.

In family law, Julia brings particular depth of experience to complex and high-stakes matters. She has extensive experience in difficult parenting disputes - including matters involving allegations of family violence, substance abuse, mental health, relocation and the intersection of criminal and family law proceedings. Julia understands that family law matters are rarely just legal problems: they involve real people at some of the most difficult points of their lives, and she approaches every matter with the combination of compassion and tenacity her clients need.

She also offers a fixed price consent orders service for parties who have reached agreement, including acting as jointly instructed solicitor for both parties where appropriate - a practical and cost-effective option that many separating couples find valuable.

Wills & Estate PlanningProbate & Estate AdministrationFamily Provision ClaimsComplex Property SettlementFamily LawEmployment LawCriminal Law

Dan brings a combination of real-life experience, frontline advocacy and genuine community commitment to his legal practice - all shaped by more than two decades of professional life before he ever set foot in a law firm.

He completed his legal studies at the University of Sydney through the Legal Profession Admission Board (LPAB), as part of a career change later in life - a decision that brought together his years of real-world experience with a long-held interest in the law. Before that, he spent more than two decades in higher education, where he became deeply involved in industrial and employee relations, eventually serving as Branch President of the National Tertiary Education Union (NTEU).

Dan now works across a wide range of areas that reflect the kinds of problems real people actually face: wills and estate planning, probate and estate administration, family provision claims, family law, property law, employment law, and criminal law. He takes the time to explain what is actually going on, works with you to find the most sensible path forward, and makes sure your voice is heard when it matters.

Dan has a particular knack for attracting unusual and complex matters - and a reputation for navigating them with quiet confidence. He regularly acts in contested property settlements involving significant or atypical asset pools, including businesses, farming properties, superannuation interests and trust structures. His estate work frequently involves tangled family circumstances, competing claims and assets that do not fit a standard template. Clients and referring solicitors alike have noted that Dan approaches complexity not as an obstacle but as the part of the job where careful thinking makes the real difference. He also has considerable experience working with high net worth clients, advising on the legal dimensions of significant wealth, complex asset structures and the particular sensitivities that come with high-value matters.

Access to skilled, committed legal representation should not depend on how deep your pockets are, and Dan takes that seriously. He has volunteered with the Far West Community Legal Centre and served as Cooperative Legal Service Delivery Coordinator - a Legal Aid funded role working to improve access to justice across the Far West region of New South Wales.

Outside the office, Dan is a keen aviator holding both fixed-wing and helicopter licences, a passion he tries to make the most of in the moments his wife and three children can spare him.

Understanding Probate

What Is a Probate Application?

When someone passes away leaving a will, their executor usually needs to obtain a grant of probate from the NSW Supreme Court before they can deal with the deceased's assets. Probate is the Court's formal confirmation that the will is valid, and that the executor has the legal authority to administer the estate.

Without a grant, most institutions - banks, share registries and the Land Registry - will not release assets or transfer property. Where a person dies without a will, a similar application called Letters of Administration must be made instead.

Grants of Probate (with a will)
Letters of Administration (without a will)
Letters of Administration with Will Annexed
Reseal of interstate or overseas grants
Full estate administration after the grant

“We take care of every step - from gathering the documents to filing the application and obtaining the grant - so executors can focus on their family rather than the paperwork.”

Not always. Small estates, jointly held assets and assets with nominated beneficiaries (like super) may not require probate. Most estates that include real estate or significant assets will. We can advise you quickly.
We file as quickly as possible - often within days of receiving all documents. The Supreme Court typically processes applications within 4–8 weeks of filing.
When someone dies without a valid will they have died intestate. An eligible family member can apply for Letters of Administration. The estate is distributed under NSW intestacy law. We handle these applications regularly.

Wills & Estate Planning

Making a Will is One of the Most Important Things You Will Ever Do.

Yet more than half of all Australians do not have one. If something happens to you without a valid will in place, the consequences for the people you love can be serious, costly and entirely avoidable.

Why It Matters

What Happens If You Don't Have a Will?

If you die without a valid will — known as dying intestate — you lose all control over what happens to your estate. NSW law decides who gets what, and the result often has nothing to do with your actual wishes.

Your partner may not automatically inherit your assets. Your children may receive nothing until they turn 18 — or find themselves in a dispute with other family members. Your business, your home, your savings — all of it distributed according to a rigid legal formula that takes no account of your relationships, your circumstances or your intentions.

And without a Power of Attorney and Appointment of Enduring Guardian, if you lose capacity before you die — through illness, injury or accident — no one will have the legal authority to manage your affairs or make decisions about your care. Not even your spouse.

Your family may not be protected

Without a will, your estate is distributed under NSW intestacy laws — not according to your wishes. Partners in de facto relationships and blended families are particularly at risk.

Your estate may be tied up for months

Intestate estates are often more complex and expensive to administer, leaving your family waiting and unable to access funds when they need them most.

Family disputes become far more likely

Without clear instructions from you, family members may disagree about your wishes — creating lasting conflict at an already difficult time.

The wrong people may inherit

Estranged relatives may be entitled to your estate while close friends, stepchildren or charities you care about receive nothing at all.

What We Can Do For You

A Properly Drafted Will Does Much More Than You Think

📋

Appoint the Right Executor

Choose someone you trust to carry out your wishes, manage your estate and deal with banks, government agencies and beneficiaries on your behalf.

👨‍👩‍👧

Protect Your Children

Nominate guardians for minor children, set up testamentary trusts to protect their inheritance, and ensure they are provided for in the way you intend.

🏡

Distribute Your Assets

Direct exactly who receives your home, investments, super, vehicles, business interests and personal belongings — and in what proportions.

💼

Plan for Blended Families

Carefully balance the interests of current and former partners, stepchildren and children from different relationships — a task that requires real expertise.

📜

Powers of Attorney

Authorise a trusted person to manage your financial and legal affairs if you lose capacity — essential protection that must be put in place before it is needed.

🛡️

Enduring Guardian

Nominate someone to make personal, lifestyle and medical decisions on your behalf — including where you live and what treatment you receive.

Time to Review

When Did You Last Update Your Will?

Your will should be reviewed after any major life event. Marriage automatically revokes a prior will in NSW. Separation does not. If your circumstances have changed, your will may no longer reflect your wishes.

Marriage or divorce
Birth of a child or grandchild
Separation or new relationship
Buying or selling property
Starting or selling a business
Death of a beneficiary or executor
Significant change in assets
More than 3 years since last review
Why Julia Clarke Solicitor

Local. Experienced. Genuinely Helpful.

We are a small, boutique firm based in East Maitland — and that is exactly the point. When you come to us to prepare your will, you deal with an experienced solicitor, not a paralegal or an online template. We take the time to understand your circumstances, your family and your wishes.

We have been helping Hunter Valley families plan their estates for over 35 years. We know that no two families are alike, and we prepare every will with genuine care and attention to detail.

A properly drafted will from a qualified solicitor is not expensive — and it is one of the most valuable things you will ever do for the people you love.

"We are a small, boutique firm where every client is known by name - not a file number. Compassion and genuine care for the people we assist are at the heart of everything we do."
